Privacy policy for social media
A. General
We, Consiliari Software GmbH, Brauerstraße 12, 76135 Karlsruhe, email: info@consiliari-software.de, maintain company profiles on various social media platforms (hereinafter “social media page(s)”). Through these social media pages, we interact with users of the social networks and regularly share content. The operators of these social media pages can record your usage behaviour using cookies and similar technologies. If you use the social networks (with a profile on our company page, in groups, etc.), the nature, scope and purposes of the processing of data in the social networks are primarily determined by the operators of the social networks. In this context, we can view general statistics on interests and demographic characteristics when you navigate our social media pages. In this privacy policy, you will find information on the processing of your personal data in connection with the operation of our social media company profiles on the following platforms:
- LinkedIn: operator LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland (hereinafter “LinkedIn”)
- YouTube: operator Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter “Google”)
You use our social media pages at your own responsibility. If you do not wish any corresponding data processing in connection with the platform operators, you are welcome to contact us via our contact form.
Where consent to the storage of information in, or access to information in, a user's terminal equipment in connection with the social media pages is required under the Act on Data Protection and the Protection of Privacy in Telecommunications and Digital Services (TDDDG), this consent is based, under German law, on Section 25(1) TDDDG.
I. Storage period
The stored personal data is erased if you have objected to the processing of your data, if knowledge of the data is no longer required to fulfil the purpose pursued by its storage, or if storage is impermissible for other legal reasons. Please note that the platform operators collect and store your data when you visit our social media pages. This also applies to cookies that the platform operators use to provide functionalities. We have no influence on this. In this respect, please note the information provided by the respective platform operators.
II. Categories of recipients, transfer to third countries
As a matter of principle, we do not transfer your data to third parties unless we are legally obliged to do so (e.g. at the request of law enforcement authorities), we require them to carry out business processes, or we use them within the scope of a data processing agreement. This applies, for example, to shipping service providers, payment service providers, inventory management service providers, service providers for order processing, web hosting providers, communication agencies, external call centres or IT service providers. In all cases, we strictly comply with the statutory requirements. In this context, data may also be transferred to other countries in which the above-mentioned contractual partners may be based or process the data. These are primarily states of the European Economic Area (EEA) and, in isolated cases, states outside the EEA. Such countries may have data protection regulations that are different from and less protective than those of the EU. This may mean, for example, that your data can be processed by authorities for control and surveillance purposes, possibly also without any possibility of legal remedy. In the event that personal data is processed outside the EU and there is no adequacy decision by the European Commission, we implement appropriate safeguards, including the conclusion of EU standard contractual clauses. You can obtain the text of the EU standard contractual clauses and the adequacy decisions on the European Commission's website: the EU standard contractual clauses are available here, the adequacy decisions are available here. Corresponding information on this can be found
- at LinkedIn, available here (note: link leads to an external page!)
- at Google, available here (note: link leads to an external page!)
III. Your rights under the GDPR
1. General
You have the right to information about the processing of personal data concerning you, a right to data portability and, where applicable, rights to erasure, rectification, restriction of processing and/or to object to processing, as well as a right to lodge a complaint with a supervisory authority. Further information can be obtained from our data protection officer, whose contact details you will find below. More detailed information on exercising your data subject rights can be found in the sections on the respective platform operators.
2. Special information on the right to object under Art. 21 GDPR
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Art. 6(1)(f) GDPR (data processing for the purposes of legitimate interests). This also applies to profiling based on this legal basis (Art. 4(4) GDPR). If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. If your objection is directed against the processing of your data for advertising purposes based on Art. 6(1)(f) GDPR, we will stop the processing immediately without further review. This also applies to any profiling carried out in such contexts.
IV. Data protection officer
For enquiries about data protection or about your personal data at Consiliari Software GmbH, you can contact our data protection officer by email: dsb@consiliari-software.de
C. YouTube
I. Processing of personal data by Google
To our knowledge, Google processes the data of users on youtube.com in particular to provide the services, maintain and improve the services, develop new services, provide personalised services, including content and advertisements, measure performance, communicate with users, and to protect itself as well as users and the public. If you are logged into your Google account and visit Google profiles, Google can assign this to your Google profile. We would therefore like to make you aware that Google stores the data of its users (e.g. personal information, IP address, etc.) and may also use it for business purposes. More detailed information on data processing by Google can be found in Google's privacy policy, here. Google uses so-called cookies to store and further process this information. These are text files that are stored on users' devices. More detailed information on Google's use of cookies and on how to deactivate them can be found under the heading “How Google uses cookies”, available here. You can configure your browser so that all cookies, including YouTube cookies, are blocked or a notification is displayed as soon as a cookie is set. Options for restricting the processing of your data are available in the privacy settings of your profile. In addition, on mobile devices (smartphones, tablet computers), you can restrict the service's access to contact and calendar data, photos, location data, etc. in the settings available there. However, this depends on the operating system used. By using the Google Dashboard, you can also review and manage certain types of information linked to your account. Using the ad settings, you can view and edit your ad preferences for Google advertising. Information on this and on further settings and choices can be found here (with further references). If you use the YouTube platform and navigate its pages, the nature, scope and purposes of the processing of data are determined by Google. We have no influence on the nature and scope of the data processed by Google, the nature of the processing and use, or the disclosure of this data to third parties, in particular to countries outside the European Union. If you wish to prevent Google from processing personal data that you transmit to us via the YouTube platform, please contact us by other means (for contact details, see the imprint or Consiliari Software GmbH.de).
II. Aggregated information
Google provides us with aggregated information, i.e. statistical data on the use of our YouTube channel.
For certain categories and time periods, Google provides the following information:
- Demographics, age, gender
- Traffic source (devices)
- Operating system
- Subscriber / non-subscriber
- Language
- Country/region/city
This aggregated information is generated and provided by Google, i.e. we have no influence on its generation and presentation.
We receive the data in aggregated form and use the statistics to make our posts and activities on our YouTube channel as appealing as possible for users. Since the statistics are only displayed above a certain number of people (e.g. information on the city only above a number of users of > 1000), they cannot be traced back to individuals. You can therefore obtain information on personal data directly via YouTube/Google. Consiliari Software GmbH processes this data on the basis of Art. 6(1)(f) GDPR. The processing enables us to optimise the functionalities of our YouTube channel and to improve our offering. These purposes also constitute our legitimate interest in processing the data under Art. 6(1)(f) GDPR.
III. Processing of other personal data by Consiliari Software GmbH
We may be able to identify users of our YouTube channel and view their profiles and shared information, e.g. when they publish, share, subscribe to or like posts on our YouTube channel. If you no longer wish this data processing in future or wish to restrict it, you can delete your posts and/or your account or undo your subscription and/or your like. Where you provide us with personal data directly via our YouTube channel (e.g. through posts), we use this data exclusively in response to your posts, e.g. to answer questions or to run prize draws. The legal basis for the associated data processing is Art. 6(1)(b) GDPR for contract-related enquiries and otherwise Art. 6(1)(f) GDPR, based on our legitimate interest in answering enquiries and posts in a user-oriented manner and, where applicable, documenting the outcome of the handling in case of follow-up questions.
V. Exercising your data subject rights
Since only Google has full access to user data, we generally recommend that you contact Google directly to exercise your rights. If you need support or have any questions, please contact us using the contact details above. We will then be happy to forward your request to Google.
